diggers.fun is a non-custodial interface to open smart contracts. Everything you need to know about using it is on this page: the terms, how we treat your data, the risks, and the software license.

Introduction

Welcome to diggers.fun (the "Interface"), a non-custodial web interface to the Diggers smart contracts deployed on Robinhood Chain. Please read these Terms of Use carefully before using the Interface. By accessing or using diggers.fun you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any of these Terms, do not use the Interface.

1. Acceptance of terms

1.1. By accessing or using diggers.fun and any related services (collectively, the "Interface"), you acknowledge that you have read, understood and agree to be bound by these Terms of Use, the Privacy Policy, the Risk Disclaimer and any additional terms referenced here (collectively, the "Agreement").

1.2. You represent and warrant that you have the legal capacity to enter into this Agreement. If you are using the Interface on behalf of an entity, you represent and warrant that you have the authority to bind that entity to this Agreement.

2. Software license

2.1. The Diggers smart contracts are licensed under the Business Source License 1.1 (BUSL-1.1). The license terms are summarized in the Software License tab of this page and are incorporated here by reference.

2.2. Subject to your compliance with the BUSL-1.1 license and these Terms, you are granted a limited, non-exclusive, non-transferable, revocable permission to use the Interface in accordance with these Terms.

3. Interface and smart contracts

3.1. The Interface provides access to decentralized functionality through smart contracts deployed on Robinhood Chain. diggers.fun serves solely as a user interface to the blockchain and public RPC nodes. The smart contracts are immutable once deployed: they have no upgrade path, no pause switch and no owner power over balances, supply or liquidity.

3.2. ASSUMPTION OF RISK: you expressly understand and agree that your access to and use of the Interface is at your sole risk, and that the Interface is provided "as is" and "as available" without warranties of any kind, whether express or implied.

3.3. NO CONTROL OVER BLOCKCHAIN: you acknowledge that diggers.fun has no control over any blockchain network, over third-party smart contracts, or over digital assets. You are solely responsible for every operation you sign through the Interface.

3.4. INTERFACE ONLY: diggers.fun does not:

  • Store your private keys
  • Process transactions on your behalf
  • Have the ability to modify, reverse or control blockchain transactions
  • Maintain custody of any digital assets
  • Link your wallet address to your identity

3.5. SMART CONTRACT RISKS: you acknowledge that smart contracts carry risk, including but not limited to bugs, exploits or other technical vulnerabilities, blockchain network failures or congestion, changes to underlying blockchain protocols, regulatory changes affecting blockchain operations, loss of access to private keys, and unforeseen technical limitations.

4. Informational purpose and no fiduciary role

4.1. The Interface presents public blockchain data in an organized, readable format and lets you interact with open protocols. It does not itself offer financial services, provide investment advice or guarantee outcomes of any interaction it enables.

4.2. NO FIDUCIARY RELATIONSHIP: these Terms are not intended to, and do not, create or impose any fiduciary duties. To the fullest extent permitted by law, you acknowledge and agree that diggers.fun owes no fiduciary duties or liabilities to you or any other party, and to the extent any such duties may exist at law or in equity, they are hereby irrevocably disclaimed and waived.

4.3. NO INVESTMENT ADVICE: nothing in the Interface constitutes investment, financial, trading or any other advice. diggers.fun is not recommending that you buy, sell or hold any token. You alone are responsible for evaluating the merits and risks of any action you take, and you should seek independent professional advice before making financial decisions.

5. No endorsement or vetting of listed coins

5.1. NO ENDORSEMENT: the listing, display or availability of any coin, token or smart contract on the Interface does not constitute an endorsement, recommendation, validation or approval by diggers.fun. Diggers is a permissionless protocol: anyone can launch a coin, and the Interface lists new launches automatically without pre-screening, review or approval. High-risk, experimental or malicious projects may appear without warning.

5.2. RESCUED TOKENS: the Interface also lists tokens originally launched on unrelated third-party platforms (shown as Rescued or Noxa tokens). These tokens were not created by, are not developed by, and are not maintained by anyone connected to diggers.fun. They do not follow the Diggers contract design, their listing is informational only, and you trade them entirely at your own risk.

5.3. DUE DILIGENCE: you assume sole responsibility for researching any coin before interacting with it, including reviewing available documentation, on-chain data and community information, and assessing risk against your own tolerance.

5.4. DISCLAIMER: diggers.fun expressly disclaims all liability for any loss or harm arising from any listed coin, including security vulnerabilities, fraudulent activity by coin creators or promoters, misrepresentations made by projects, regulatory issues, or financial loss resulting from your interaction with any listed coin.

5.5. INTERFACE CURATION: while the underlying protocol is permissionless and no one can remove a coin from the blockchain, the Interface reserves the right, at its sole discretion and without notice, to hide, delist or restrict the display of any coin, image, name or other content on the Interface, including content that is unlawful, infringing, deceptive or abusive. Delisting from the Interface never affects the on-chain contracts or your ability to interact with them through other means.

6. Coin creators and uploaded content

6.1. Anyone who launches a coin through the Interface (a "Creator") represents and warrants that they own, or have obtained all necessary rights and permissions to use, every name, ticker, image and piece of metadata they upload, and that such content does not infringe the intellectual property, publicity or privacy rights of any third party and is not unlawful, deceptive or obscene.

6.2. Creators are solely responsible for any public statements, marketing or promotion they make about their coins. Creators must not misrepresent their coin's configuration, tokenomics, fee settings, locks or any other property, and must not conceal any personal financial interest when promoting a coin.

6.3. Fee splits, locks and any other arrangements between a Creator and their team members, promoters or other third parties are strictly between the Creator and those parties. diggers.fun is not a party to, does not police, and accepts no liability for any such arrangement.

6.4. NO CAPITAL RAISING: you must not use the Interface or the protocol to conduct any capital raise, pooled investment scheme, profit-sharing arrangement, or to issue tokens intended to represent equity, debt, revenue participation or any other ownership or investment interest in a business or enterprise. You are solely responsible for ensuring that any coin you launch complies with all laws applicable to you, including securities laws.

7. Fees, rewards and taxes

7.1. Pool fees, fee splits, burn shares and reward mechanics are chosen at launch and enforced by immutable smart contracts. Any numbers shown on the Interface (prices, quotes, fee estimates, reward projections) are estimates: the actual result of any transaction is determined solely by the smart contracts and network conditions at execution time and may differ from the display, for example due to slippage or rounding. You also pay network gas on every transaction, which goes to the blockchain network and not to anyone connected to diggers.fun.

7.2. REWARDS ARE NOT INCOME: Daily Contest payouts, creator fee accruals, $DIG minting and any other protocol rewards are conditional mechanics executed by code. They depend entirely on on-chain activity by other participants, may fail to accrue or be distributed, carry no minimum, no fixed rate and no guarantee of any value, and are not interest, dividends, yield or any other form of assured payment. Do not treat any protocol reward as predictable income.

7.3. TAXES: you are solely responsible for determining, reporting and paying all taxes arising from your activity, including trading gains, creator fee income, contest payouts and $DIG rewards, in every jurisdiction that applies to you. Nothing on the Interface is tax advice.

8. Non-custodial nature

8.1. diggers.fun is not a broker, financial intermediary, money transmitter or virtual asset service provider. The Interface never hosts, stores or takes custody of user assets at any time.

8.2. All transactions are:

  • Executed directly by you through your own wallet software
  • Recorded directly on Robinhood Chain without passing through any diggers.fun server
  • Verified and finalized by the blockchain network, not by diggers.fun

8.3. You remain fully responsible for the security of your private keys, wallet applications and every transaction you sign. diggers.fun has no ability to recover lost funds, reverse transactions or access your assets under any circumstances.

9. Loss of funds and irreversible transactions

9.1. diggers.fun expressly disclaims all responsibility for any loss, damage or theft of digital assets arising from your use of the Interface. The Interface cannot cancel, reverse or alter any transaction once initiated and cannot access your wallet, keys or recovery phrases.

9.2. IRRECOVERABLE LOSSES: there is no means, capability or obligation to recover, restore or compensate you for lost assets, including losses from sending assets to wrong addresses, compromised keys or seed phrases, phishing or malware, smart contract errors or exploits, failed transactions, user error, or regulatory actions. There is no insurance policy or reserve fund. By using the Interface you accept that any loss of funds is your sole responsibility.

10. Disclaimer of warranties and limitation of liability

10.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIGGERS.FUN DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. NO WARRANTY IS MADE THAT THE INTERFACE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE OR ACCURATE.

10.2. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DIGGERS.FUN OR ITS CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE INTERFACE.

10.3. IN ANY CASE, THE AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE INTERFACE SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO DIGGERS.FUN FOR USING THE INTERFACE IN THE PRIOR 12 MONTHS, OR 100 USD.

10.4. TIME LIMIT ON CLAIMS: any claim arising out of or relating to the Interface must be commenced within one (1) year after the events giving rise to the claim; otherwise it is permanently barred, except where a longer minimum period is mandated by applicable law.

10.5. FORCE MAJEURE: no liability arises from any delay or failure caused by events beyond reasonable control, including blockchain network failures or congestion, attacks on the network or its infrastructure, actions of third-party providers, acts of government, natural disasters or similar events.

11. Indemnification and release

11.1. You agree to defend, indemnify and hold harmless diggers.fun and its contributors from and against any claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of the Interface, any content you upload, or your violation of the rights of any third party.

11.2. RELEASE: any dispute between you and a Creator, another user or any other third party (including disputes about a coin's promotion, fee splits or community conduct) is strictly between you and that party. You irrevocably release diggers.fun and its contributors from any and all claims and demands arising out of or connected with any such dispute.

12. Third-party services and data

12.1. The Interface may contain links to, or embed content from, third-party websites and services (for example block explorers and charting widgets) that are not controlled by diggers.fun. No responsibility is assumed for their content, privacy practices or availability, or for any damage or loss caused by your use of them.

12.2. DATA IS INFORMATIONAL: prices, charts, market caps, volumes, holder counts, leaderboards and similar figures shown on the Interface are best-effort displays of public blockchain data and third-party feeds. They may be incomplete, delayed or inaccurate, they can change without notice, and reliance on them is at your sole risk. The blockchain itself is the only authoritative record.

13. Compliance with laws

13.1. You agree to comply with all applicable domestic and international laws and regulations regarding your use of the Interface. The Interface is not directed to persons in jurisdictions where its use would be contrary to applicable law.

14. User representations

14.1. By using the Interface, you represent and warrant that:

  • You are at least 18 years of age
  • You are not located in, under the control of, or a national or resident of any country subject to embargo or sanctions, and you are not on any sanctions or denied-persons list
  • You are not using a VPN, proxy or other means to disguise your location in order to evade sanctions or other legal restrictions
  • You are not using the Interface for any illegal purpose
  • You have sufficient knowledge and experience to evaluate the merits and risks of using the Interface
  • You understand that blockchain transactions are irreversible and cannot be canceled
  • You are solely responsible for the security of your private keys and credentials

15. Prohibited activities

15.1. You agree not to engage in any of the following:

  • Violating any applicable law, rule or regulation
  • Impersonating another person, entity or project
  • Market manipulation of any kind, including pump-and-dump schemes, wash trading, spoofing, or spreading false or misleading information about any coin, on or off the Interface
  • Launching or promoting a coin using names, tickers or images that infringe third-party rights or deceive users about affiliation or endorsement
  • Interfering with or disrupting the Interface or connected networks
  • Scraping, crawling or querying the Interface with automated tools in a way that imposes an unreasonable load on its infrastructure
  • Attempting to gain unauthorized access to any part of the Interface
  • Using the Interface for any fraudulent or unlawful purpose
  • Transmitting malicious code of any kind
  • Encouraging or enabling anyone else to do any of the above

16. Modifications to terms

16.1. These Terms may be modified or replaced at any time. By continuing to use the Interface after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, stop using the Interface.

17. Governing law and disputes

17.1. These Terms shall be governed by and construed in accordance with generally accepted principles of law applicable to online software interfaces, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved on an individual basis; class actions and class arbitrations are not permitted.

18. Severability and waiver

18.1. If any provision of these Terms is held to be unenforceable or invalid, it will be interpreted to accomplish its objectives to the greatest extent possible, and the remaining provisions will continue in full force. Failure to enforce any right or provision is not a waiver of it.

19. Entire agreement

19.1. These Terms constitute the entire agreement between you and diggers.fun regarding the Interface and supersede any prior agreements.

BY USING THE INTERFACE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM.
